I created this contract to protect you as the client and myself as the artist. In a perfect world no one would ever need a contract because everyone would be payed for work they've done and everyone else would happy with the work they've payed for, but alas this world is not the one we live in. So this contract is just a way to make sure you receive your commissioned artwork and I receive payment. It's also a way for me to lay out in detail exactly how I work with clients. Once a client confirms that they wish to commission a tattoo design, they will receive this contract in an email. Once received, it is the clients' responsibility to read and understand the contract, and to express and questions or concerns regarding it.
WHAT TO EXPECT If you commission a tattoo design for me you can expect to receive a final design that you are 100% pleased with. I consider a tattoo design to be a collaboration, meaning I work with my client to guarantee the design is exactly what they want it to be, down to every detail. I like to remain in contact with my client while designing the tattoo, and will provide photos throughout the process to make sure they are happy with every detail of the design. Throughout the process a client may change their mind about what they want the design to be, request small details be changed, request the redrawing of certain aspects of the design - all these things are welcomed. The design is intended to be a final product to be used as a tattoo, and because tattoos are permanent I understand the necessity of the design being 100% exactly how the client wants it to be. I do not consider a project to be complete until the client is completely satisfied. Details such as payment and completion time will be discussed fully before I begin working on a design. I will be honest about when I am able to begin the design, how long it will take, and how much it will cost. I require a constant line of communication between myself and the client during the design process. This can be through email, through direct messaging on facebook / etsy, through text, etc. As I progress through the design I will send pictures to the client to guarantee their satisfaction. If a client fails to remain in contact, or respond to my attempts to contact them, it could greatly affect the amount of time it takes to complete the design. I will not progress on a design if I do not receive a response from a client. My goal is to avoid being completely finished with a design and a client request changes to be made. The desirable process is to make changes and alterations during the design process, not after. However, I am committed to creating a design that is exactly what my client wants. After you have received and paid for your tattoo design, the design will never be sold to another client. The design belongs to you. However, I reserve the right to use the design in my portfolio, as an example as my work, to be viewed only. In most cases, the design will contain shading and possibly color. If this is the case then you will receive two completed versions. One version will be a simple outline of the design, which can be transferred to you easily by your tattoo artist. The second version will be a completed work with shading, color, etc. that will give your tattoo artist an exact idea of what you want. The final design/s will be in digital form as JPEG files. JPEG files are easy to use, save, email on any computer. I scan the final design and use digital files to make the sizing of your design easy and convenient. For example, if you want a small design and I draw it larger than you desire, the design can easily be made smaller from the digital file. Likewise, if the design is not quite as big as you would like, size can easily be increased. If transactions are made via my Etsy page, than the digital files will be available to download as soon as final payment is made. Otherwise, the files will be emailed to you directly using an email address you have provided. WHAT I EXPECT Like previously described, I expect my client to keep an open line of communication, and remain responsive if I send a picture of the design progressing, and express their feelings on the design. It's as simple as saying "yes that's good" if you are pleased with the design so far, and if not or you see even the slightest detail you would like changed please let me know. I view myself as a professional freelance artist, and respectfully expect my clients to as well. My time, resources, and artwork are valuable. I expect to be paid for my work, in the full amount previously discussed, and in a timely manner. If the final payment is never received from a client who has commissioned work, then the artwork created for said client will then be made available for others, and re-sold accordingly. PAYMENT At this time, all tattoo designs start at $30 - which will be paid in full before I begin working on the design. If the design is large, highly detailed, or you want it to be colored, the amount will increase (up to $10 more). The client will describe what they would like in full, and payment will be discussed and agreed upon before I begin working on the project. In cases of the design costing more than the $30 upfront payment, the remaining payment will be paid in full after the completion of the design. REFUNDS If you are not happy with your design for whatever reason, and the design has already been completed, I will refund you half of the payed amount (equaling $15). I keep half of the payment to account for the time I have already spent working on the design. If the client is displeased, and receives their refund, then there is a possibility that the design may be used in other ways and/or resold to other clients. If the design has been completed and the final digital file has been emailed to the client, then no refunds are issued. If you decide after talking with me that you no longer wish to work with me (before the start or completion of the design) then your payment may be refunded in full.
